Leaders in Employment Law & Health & Safety

Hybred is a progressive employment law and health & safety advice service

We are different to most other advisers – our advice is never out of a book; we will work with you to find a solution to your problem (however complex) by giving you a range of actions you could take with a risk / benefit analysis of each that will put you in the driving seat, able to confidently decide the best course of action. And, as we are specialists, we can be bold and inventive with the recommendations we make.

We offer a new approach to legal and compliance services that is modern, flexible and progressive. The cost savings we make by reducing the overheads associated with flashy offices and a team of support staff are translated into affordable rates for our clients and none of the stuffiness associated with old fashioned firms.

Affordability, efficiency, personal service and professionalism are the cornerstones of our business.

Employment Law Services

Grievances
What should you do if you receive a complaint from an employee?

Most importantly, stay calm, dealing with a grievance effectively can help avoid tribunal claims. It is very important to say and do the right things but with us guiding you through the process this should be straight forward. We will tell you whether the complaint is anything to worry about and what you can do to resolve it. We take a “hands on” approach to our work and will happily attend meetings and carry out investigations with you to ensure that things go smoothly.

Sickness Absence
Persistent short term absences can be a real problem for employers.

Many employers believe that you can’t dismiss someone for poor attendance. This is not true; you can, provided that the correct procedures are followed. We can guide you through this process step by step.

Long term sickness absence needs to be handled carefully to avoid potential disability discrimination claims but, provided that you take a few simple steps, we are confident that you will be in a position, within a reasonable period of time, to either get your employee back to work or dismiss them fairly for capability.

Misconduct and Poor Performance
Misconduct and poor performance are a major headache for employers representing the most difficult dismissals to carry out fairly.

With our help, you will feel confident investigating allegations, holding hearings and applying disciplinary sanctions.

Although poor performance is not a disciplinary issue, the process is similar, involving a series of investigations and meetings.  But what if you just know a particular employee is not right for your organisation? What if you think you have left it too late to act?

Do not despair. There are alternatives to the long and drawn out process recommended by most advisers – we can tell you what to do to achieve a quick and amicable resolution.

Contracts, Policies and Procedures
By law, all workers are entitled to receive a written statement of terms on or before the first day of employment.

We can draft these for you at very competitive rates. Contracts will be tailored to suit your business and we always use clear, simple language. Some of the contents is required by law but we go the extra mile recommending clauses that are optional but that will give you additional protection.

We can also provide the full package of policies and procedures that go into a Staff Handbook to give your business the best possible protection against potential claims. Or, if cost is an issue, we can recommend a sensibly slimmed down version suitable for a smaller employer.

Equality
Unlimited compensation for claimants and damaging publicity for employers make discrimination claims particularly unpleasant to receive. Especially as apparently innocent and indirect acts can be discriminatory.

If a claim lands on your desk then stay calm and get in touch, we can sometimes persuade claimants to withdraw claims, we are experts at settling disputes and if the case goes to a full hearing we can make sure you are robustly defended. We can also advise on measures to help avoid future claims.

The first step towards avoiding discrimination claims is to put in place an Equal Opportunities Policy, but this on its own will not be enough to defend a claim. You must also be able to demonstrate, as a minimum, that your employees have received adequate training on equality. We can provide up to date documentation for you and in house equal opportunities training that is fun and interactive, at a time and price to suit you.

This will help you to both avoid and defend claims (should the worst happen).

Settlement Agreements
When used with care, settlement agreements are a good way to achieve a quick, clean break but, if presented wrongly, they could lead to claims being made against you.

We can advise you on how to introduce the idea of a settlement agreement to an employee you would like to exit and can carry out the ensuing negotiations with their legal adviser on your behalf to achieve the best possible outcome for you.

We can also provide an expertly drafted agreement tailored to your needs and designed to give you maximum protection against future claims.

Dismissals

All employers want their employees to succeed. However, sometimes, despite everyone’s best efforts, it is necessary to carry out dismissals – whether for redundancy, misconduct or some other substantial reason.

We understand that dismissal procedures can be daunting for those involved which is why we offer a hands-on approach, meaning that we can help with investigations and attend meetings with you as well as providing step-by-step guidance on what to do, how and when. This will enable you to carry out dismissals efficiently, fairly and confidently. We offer flexible packages to suit your budget and level of expertise. You tell us what you want and we will do our best to deliver it.

Employment Tribunal Proceedings
If, despite your best efforts, you are faced with a claim, then we can make sure you are robustly defended.

The level of support provided will be tailored to your needs and level of expertise. The first step is to put in a strong defence. If appropriate, we can then discuss either persuading the claimant to withdraw their claim or entering into settlement negotiations with them. It is worth knowing that the majority of cases do not go all the way to a full hearing. Either way, you can rest assured we will work hard to get you the best possible result. If the case does go to a hearing we will be flexible – we can either represent you in the tribunal ourselves or, if the case requires the expertise of a barrister, we can arrange this for you ensuring a seamless service from start to finish.

Redundancies
Redundancies happen when you have a reduced requirement for employees to carry out work of a particular kind or in a particular place. This could be for a number of reasons; a fall in sales, relocation or a restructure.

There is a lot to remember, from selection and consultation to offers of alternative employment, notice, appeals and calculating redundancy pay. Mistakes can lead to costly tribunal claims. We can help you avoid claims by guiding you step-by-step through the process, supplying all the necessary documentation, answering any questions and if you would like us to do so, we can even attend the meetings with you to ensure everything goes smoothly.
